These Terms of Service ("Terms") govern your access to and use of Swankflow, a software-as-a-service platform operated by Swankflow ("Swankflow," "we," "us," or "our") that lets home service businesses build signup forms and sync submissions to Jobber. By creating an account, accessing the platform, or using our services in any way, you agree to be bound by these Terms.
Swankflow provides a hosted form-builder and integration platform that connects to your Jobber account, lets you build branded signup forms for your customers, and automatically syncs submissions to Jobber as clients, properties, requests, quotes, or jobs. Optional features include automated email (welcome and review-request messages), custom domains, white-label sender domains, and tracking-pixel integrations.
You must be at least 18 years old and authorized to enter into agreements on behalf of any business you represent. By creating an account you confirm that the information you provide is accurate, and that your use of Swankflow does not violate any law or third-party right.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us at hello@swankflow.com immediately if you believe your account has been compromised. You may not share your login credentials, sell or transfer your account, or use your account in a way that disrupts other users.
Swankflow offers a free trial tier and paid subscription plans (Pro, White Label). Paid subscriptions are billed monthly in advance via Stripe. You authorize us to charge your payment method on a recurring basis until you cancel. Cancellations take effect at the end of the current billing cycle; access continues until then.
Refunds: we do not generally offer refunds for partial billing periods. If you believe you were charged in error, contact hello@swankflow.com within 30 days and we will review on a case-by-case basis.
Price changes: we may change subscription prices with at least 30 days' notice via email. Continued use after the effective date constitutes acceptance.
Free-trial accounts are limited to 10 form submissions per calendar month. Paid plans include unlimited form submissions subject to fair-use limits intended to prevent abuse (excessive volume, spam, or activity that disrupts platform stability). We may impose rate limits or temporarily throttle accounts that meaningfully exceed reasonable use. If we suspect abuse we will contact you before suspending service except in cases of imminent harm.
You agree not to:
You retain all ownership of the content you submit through Swankflow, including your form designs, customer data, branding, and any text or media you upload. You grant Swankflow a limited, worldwide, non-exclusive license to host, process, and display your content solely as needed to provide the service.
You represent that you have all necessary rights and consents to upload and process the content you provide, and that doing so does not violate any third-party right or applicable law.
When customers submit your forms, you become the data controller for the personal data they provide (name, email, phone, address, etc.). Swankflow acts as your data processor under that submission and processes the data only as needed to provide the service. Our handling of personal data is described in our Privacy Policy.
You are responsible for posting and complying with your own privacy policy and terms of service, and for obtaining any consents (including email and SMS consent where applicable) required by applicable law in the jurisdictions where you collect data.
Swankflow integrates with third-party services including Jobber (CRM), Stripe (billing), Resend (transactional email), Cloudflare (hosting and DNS), and Anthropic (AI assistant). Your use of those services is governed by their own terms and privacy policies. Swankflow is not responsible for the availability, performance, or actions of third-party services.
Swankflow, its logo, code, designs, and documentation are the property of Swankflow and are protected by intellectual-property laws. Nothing in these Terms grants you any right or license to use Swankflow's trademarks, logos, or proprietary materials except as expressly permitted in writing.
We aim for high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time, with reasonable notice for material changes. Planned maintenance will be announced in advance where feasible.
You may cancel your account at any time from your billing settings. We may suspend or terminate your account if you violate these Terms, engage in fraudulent or abusive behavior, or fail to pay applicable fees. Upon termination, your access ends and your data may be deleted after a reasonable retention period (see the Privacy Policy).
Swankflow is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free, secure, or uninterrupted, or that it will meet your specific requirements.
To the maximum extent permitted by law, Swankflow's total aggregate liability arising out of or related to these Terms or your use of the service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. In no event shall Swankflow be liable for indirect, incidental, consequential, special, or punitive damages (including lost profits, lost data, or business interruption), even if advised of the possibility of such damages.
You agree to indemnify and hold Swankflow harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the service, your content, your violation of these Terms, or your violation of any third-party right.
These Terms are governed by the laws of the jurisdiction in which Swankflow is incorporated, without regard to conflict-of-law principles. Any dispute will be resolved through good-faith negotiation first, and if unresolved, through binding arbitration or in courts located in our home jurisdiction.
We may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
